This policy supplements the Site’s General Terms, of which it forms an integral part, to inform you about the processing of personal data on the Site.
1. DEFINITIONS
The terms beginning with a capital letter refer to the following definitions:
The “Company” or “we” means the company HelloSoftware SA, Route de Lausanne 134, Le Mont-sur-Lausanne, Suisse - help@fileworld.co.
The “Site” means the website(s) accessible via the URL link https://fileworld.co and any possible sub-site(s) allowing access to a content dashboard, a client workspace, etc. provided by the Company.
the term “You” means the individuals concerned by the Processing carried out on the Site (users, prospects, customers, etc.).
The “Policy” means this privacy protection policy.
“Data” means any information relating to an identified or identifiable natural person (“the “data subject”), directly or indirectly, in particular by reference to an identifier (name, identification number, location data, online identifier, etc.) or to one or more factors specific to their identity.
“Processing” means any operation performed on the Data (collection, recording, organisation, storage, adaptation, communication by transmission, dissemination, erasure, etc.)
A “Data Controller” is the person who, alone or jointly with others, determines the purposes and means of the Processing, and a “Data Controller” is the person who processes the Data on behalf of the Controller. On the Site, unless otherwise stated, we act as the data Controller.
A “Recipient” is any natural or legal person, public authority, service or other body to whom personal data are disclosed, whether or not it is a third party.
The “Regulation” means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”); Law No. 78-17 of 6 January 1978 on information technology, files and civil liberties; the rules applicable to commercial prospecting provided for by the Postal and Telecommunications Code, and more generally the laws and regulations applicable to the Data Processing we carry out.
2. COMPANY WEBSITE AND COMMERCIAL PROSPECTING
HelloSoftware SA acts as the Controller, responsible for collecting, processing and storing personal data in compliance with the applicable data-protection laws in order to safeguard your privacy
The Site showcases our Company’s activities and various forms (contact, newsletter subscription, etc.). By completing these forms and communicating with us via the Site, you send us the following categories of information:
- Identity data: civility/gender; last name; first name; and, optionally, we may ask for your date of birth in order to send you birthday offers;
- Contact and correspondence data: email address; postal address (street, postcode, city); telephone number; in the event of a customer-service request, the nature and content of your query.
- Reviews and contributions: username, date of the review, content of the review, product or service concerned, profile photo attached to the review, where applicable; the Company may enrich its Site by collecting and republishing reviews and contributions posted by its clients on other sites (in particular on social networks) when such contributions are publicly accessible;
- Data required for loyalty, lead generation, studies, surveys, product testing and promotional campaigns ;
- Data relating to the organisation and processing of contests, lotteries and any promotional operation ;
- Data collected in connection with the exercise of the rights provided for by the regulations.
In accordance with our legitimate interests, and where necessary for the performance of pre-contractual measures taken at your request or of a contract, we process the above-mentioned data for the following purposes :
- Presentation of the Company’s products and services ;
- Management, processing and tracking of requests and interactions with the Company, via the Platform (where applicable by offering you a chatbot, a call-booking tool, etc ;)
- Management of the relationship with prospects ;
- Management of user reviews of the Company’s products, services or content ;
- Lead generation and/or information mailing, management of technical canvassing campaigns, selection of users to carry out loyalty actions, prospecting, surveys, product tests, etc ;
- Organisation of contests, lotteries or any promotional operation on the Platform.
Data used for managing commercial canvassing are kept for a maximum of three years from the last active contact of the prospect or customer, and earlier if you withdraw your consent to receive messages from us. Data relating to reviews and contributions are retained for as long as the review remains publicly accessible on the site.
In accordance with our legal obligations, identity and contact data will also be processed for the following purposes :
- Updating our prospecting files by the organisation in charge of managing the telephone marketing opt-out list, in application of the provisions of the Consumer Code
- Management of requests to exercise rights of access, rectification and objection, and more generally the rights described in the Policy.
3. ONLINE SUBSCRIPTIONS
The Platform allows you to subscribe online, which leads us to process the following Data :
- Identity and contact data
- Data relating to the contractual and commercial relationship : Details of the order content ; pre-contractual exchanges and those relating to the order (subject, date, etc.) ; communications with the Company.
- Payment and transaction data : transaction date, amount, payment method, order number, billing data ;
This information is required to manage our client-prospect database, and more specifically for the following purposes in accordance with our General Terms accepted when placing the order on the Platform and with our legal obligations :
- Carrying out operations relating to file management concerning : subscriptions ; orders ; delivery of the product or the service ; statutory and commercial warranties ; invoices ; accounting and monitoring of the commercial relationship (after-sales service) including reviews of the Company’s offers ;
- Preventing and combating fraud and payment fraud, including credit-card fraud ;
- Managing unpaid amounts and disputes, provided they do not concern offences and/or lead to a person being deprived of a right, benefit or contract.
Secure payment. All transactions carried out on our Site are secure. Credit card payments are processed by our payment service providers (“PSPs”), as indicated in our general terms or on the order page of our products and services. We use an SSL encryption system to protect your personal data and the payment methods used. At no time do we have direct access to your banking details through this channel.
Retention period. The personal data we process are retained for the periods set out in the table below.

4. ACCOUNT CREATION
A personal account is automatically created on the basis of the information provided when you place your order on the Platform.
To provide and manage the account, the following information will be processed :
- Identity and contact data
- Account login data : username, password ; which can be recorded automatically on the Platform only if you give your consent via your browser settings ;
- Account access and usage data : IP address, connection time, connection duration, account settings, data related to the use of account features.
5. USE OF COOKIES
When you visit our platform, cookies and similar technologies may be placed on your device, subject to your consent where required by law. Cookies are small text files that allow us to recognize your browser, store information, and track certain data related to your use of the site.
